Terms of Service

By creating an account, signing in, or otherwise accessing or using MPSS (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a binding legal agreement between you and Yarify s.r.o., the operator of MPSS:

MPSS (Media Publishing & Scheduling System) is a content automation platform that enables users to:

• Create and manage media collections (images, videos, audio files).
• Define video templates and content pools for automated video composition.
• Schedule recurring publishing campaigns to connected social media accounts.
• Publish generated video content to YouTube, Instagram (Reels), and TikTok.

The Service is provided on a software-as-a-service basis. Features may change over time.

You must be at least 18 years of age to use the Service. By using MPSS, you represent that you meet this requirement.

Authentication is handled via Google Sign-In (Firebase Authentication). You are responsible for maintaining the security of your Google account. Yarify s.r.o. is not responsible for any loss or damage arising from unauthorised access to your account caused by your failure to maintain account security.

Each account is for a single user. You may not share your login credentials with others or allow others to access the Service through your account.

MPSS allows you to connect third-party social media accounts (YouTube, Instagram, TikTok) via OAuth authorisation. By connecting an account, you:

• Authorise MPSS to store encrypted OAuth access and refresh tokens in order to publish content on your behalf according to the schedules you configure.
• Acknowledge that MPSS will transmit video content and associated metadata (titles, descriptions, captions, tags) to the connected platforms at the time of publishing.
• Remain solely responsible for ensuring that any content published through MPSS complies with each platform's terms of service, community guidelines, and applicable law.
• Understand that you can revoke platform access at any time by disconnecting the account within MPSS or by revoking authorisation directly in the respective platform's settings.

MPSS requests only the minimum scopes necessary for publishing (see our Privacy Policy for the full scope list). We do not use these permissions to read your social media feed, followers, messages, or any data beyond what is necessary to complete a publish operation.

Platform APIs may be modified or restricted by the respective platform at any time. Yarify s.r.o. does not guarantee uninterrupted availability of any social platform integration.

You agree not to:

• Use the Service to publish content at volumes or frequencies that violate platform API rate limits, terms of service, or spam policies.
• Attempt to reverse-engineer, decompile, or otherwise derive the source code of the MPSS application.
• Use automated means (other than MPSS itself) to access, scrape, or interact with the MPSS application.
• Introduce malicious code, viruses, or harmful data into the Service or any connected system.
• Circumvent any access controls, authentication, or security mechanisms.
• Impersonate another person or entity when using the Service.
• Use the Service in a manner that violates any applicable law or regulation.

Yarify s.r.o. reserves the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

You are responsible for the content, timing, and frequency of all campaigns and scheduled runs you configure in MPSS. Yarify s.r.o. is not responsible for:

• Publication failures caused by expired OAuth tokens, platform API outages, or quota limits.
• Content published as a result of misconfigured schedules or templates.
• Actions taken by social media platforms in response to published content (removal, account penalties, etc.).

MPSS displays publish outcomes (success/failure) and post links. You should monitor your campaigns regularly.

MPSS is provided "as is" and "as available". We aim to maintain a reliable service but do not guarantee uninterrupted availability, error-free operation, or that the Service will meet your specific requirements.

We may perform scheduled or emergency maintenance at any time. We will make reasonable efforts to give advance notice of planned downtime.

The MPSS platform, including its software, design, logos, and documentation, is owned by Yarify s.r.o. and protected by intellectual property law. Nothing in these Terms transfers any intellectual property rights to you.

"MPSS" and "Yarify" are trademarks of Yarify s.r.o. You may not use these marks without our prior written consent.

To the fullest extent permitted by applicable law, Yarify s.r.o. disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be available at all times or free from errors.
• Content published through the Service will achieve any particular reach or engagement.
• Platform integrations will remain available or uninterrupted.

To the fullest extent permitted by applicable law, Yarify s.r.o. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or social media account standing — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Yarify s.r.o. in the twelve (12) months preceding the claim (or €100 if you have not made any payments).

Nothing in these Terms limits liability that cannot be limited under Czech or EU consumer protection law.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you agree to the collection and use of your data as described therein.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

You may stop using the Service at any time. You may request account deletion by contacting sales@yarify.tech.

Yarify s.r.o. may suspend or terminate your access at any time if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, and governing law) will survive.

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts in Ostrava, Czech Republic.

If you are a consumer resident in the EU, you retain the benefit of any mandatory consumer protection provisions of your country of residence.
